What if the defendant is bankrupt?
Many companies that made products containing asbestos have filed for bankruptcy protection. In these cases, the bankruptcy judge may set up a trust fund with the company’s assets to compensate victims who were adversely affected by the company’s asbestos-containing products. In these cases, the compensation you might receive through the trust fund is generally less than what you might have received if the company didn't file for bankruptcy.
